EP Fastpitch and Eden Prairie Softball Facilities Code of Conduct Policy:
Eden Prairie Fastpitch (“EPFP”) is a non-profit, volunteer operated and managed youth sports organization dedicated to developing and promoting excellence in girl’s fastpitch softball. The primary goal of EPFP is to develop and teach the fundamentals of softball in a healthy, safe, and positive environment.
A fundamental part of creating this environment involves the conduct of all players, coaches, parents, officiants, administrators, volunteers, spectators, and others present before, during and after practices, warm-ups, games and other EPFP events occurring at or in the immediate vicinity of our home field, Miller Park and ancillary Eden Prairie facility locations. This Code of Conduct Policy is considered a contract between any coach, player, parent, officiant, administrator, volunteer, spectator or others attending any activities at Miller Park or any ancillary Eden Prairie field locations.
If this Code of Conduct Policy is being presented to another organization, the person signing this Code of Conduct Policy shall be considered responsible for the actions of everyone in their organization or in attendance in support of their organization.
1. Disruptive Conduct shall be defined as any of the following:
a. Consuming alcohol at any practice, game or EPFP-sponsored event;
b. Arriving at a game, practice or EPFP-sponsored event while under the influence of alcohol, any illegal drug, or any controlled substance without a subscription;
c. Engaging in physical and/or verbal conduct that significantly interferes with or impedes the orderly conduct of a practice, game, team meeting or other EPFP-sponsored event;
d. Engaging in physical and/or verbal conduct that interferes in a minor way with a practice, game. team meeting or other EPFP-sponsored event, where such conduct continues despite being asked by a coach, authorized EPFP representative, or game official to stop the physical and/or verbal conduct;
e. Communicating with any coach, player, parent, officiant, administrator, volunteer, or spectator so as to significantly interfere with a practice, game, team meeting or other EPFP-sponsored event.
f. Communicating that interferes in a minor way with a practice, game, team meeting, or EPFP-sponsored event where such conduct continues despite being asked by a coach, authorized EPFP representative, or game official to stop the interfering communication;
g. Communicating with parents, players, coaches, spectators or others in such a way as to demean or defame any coach, player, parent, officiant, administrator, volunteer, or spectator.
h. Engaging in any communication with a coach, player, parent, officiant, administrator, volunteer, spectator or others where such communication is, or may reasonably be viewed by others to be, abusive, bullying, threatening, aggressive, intimidating or embarrassing.
2. If a determination is made that a person has engaged in Disruptive Conduct, such person may be sanctioned as appropriate in any one or more of the following ways:
a. Issued a verbal and/or warning to cease engaging in such Disruptive Conduct.
b. Banned from attending in any way, future practices, games, team meetings, and EPFP-sponsored events.
i. Such ban may include some or all of the remaining practices, games, team meetings, and/or EPFP-sponsored events in such year.
ii. If such a ban is imposed, the ban shall not prevent a parent from dropping off or picking up their own child from the event at issue provided the parent remains in a vehicle and is present only for such time as is reasonably necessary to drop off or pick up the child.
c. A permanent ban from all future EPFP/Miller Park practices, games, team meetings, or other EPFP-sponsored events indefinitely.
3. Investigation of the existence of Disruptive Conduct.
a. Any complaint of Disruptive Conduct shall be investigated by the appropriate EPFP Softball Director(s). Such investigation shall include, but is not necessarily limited to, a review of any documentation, video or recordings that evidence the alleged Disruptive Conduct, and an interview of witnesses and individuals directly involved. The interviews may be in the form of face-to-face meetings, telephone conference or electronic communications that allows witnesses and involved individuals to state their version of the incident(s) in question. In the event that the EPFP Softball Director is involved in anyway in the incident, the investigation shall be conducted by a representative appointed by the EPFP Board of Directors.
4. Determination of the Disruptive Conduct.
a. At the conclusion of the investigation, the person conducting the investigation shall present his/her findings and recommendations to the EPFP Board of Directors to make a determination of the appropriate sanction(s), if any, to be imposed. If any sanction(s) other than a warning is determined to be appropriate, then the disruptive person shall be notified in writing by the President of EPFP. The sanction(s) shall be effective immediately. However, the sanctioned person may appeal the determination to an Appeals Panel, as defined below.
b. Notification of the sanction(s) shall be deemed to have been made upon the earlier of either personal delivery, or three (3) business days following deposit with the U.S. Post Office, first class postage pre-paid, of a letter of notification mailed to the last-known home address of the person sanctioned, or head of any affected professional organization, as applicable.
5. Appeals. In the event a determination is made involving any sanction(s) other than the issuance of a warning, an appeal may be made by the sanctioned person as follows:
Only the person sanctioned may appeal. The appeal must be made in the form of a written request for reconsideration to be submitted within seven (7) days of the notification of the sanction(s). Requests are to be mailed to Eden Prairie Fastpitch, P.O. Box 46452, Eden Prairie MN 55344.
a. Appeals shall be conducted by a panel of four (4) members of the EPFP Board of Directors. Those Board of Directors members shall consist of the four (4) currently-elected officers of EPFP; provided, however, that in the event any such officer(s) is/are unable or unwilling to participate in the appeal the remaining officers may appoint a replacement(s) to be drawn from other members of the EPFP Board of Directors.
b. Appeals shall be heard in person with all affected parties being given an opportunity to present to the panel in person his/her version of the facts and circumstances related to the incident in question. To reduce friction and further conflict, the panel may choose to listen to any one or more of the affected parties separately and/or at different times.
